Employee Terms and Conditions

1. Introduction to Tipinc

  • Tipinc is a digital tipping platform developed and owned by Tipinc Limited (“we,” “us,” “our”), offering solutions through mobile applications available on iOS and Android.
  • As an employee of a venue using one of our tipping solutions, you (the “Employee”) agree to appoint Tipinc as your non-exclusive commercial agent to collect tips on your behalf and distribute them to you.
  • These Employee Terms and Conditions must be read in conjunction with our Platform Privacy Policy and End User License Agreement. We reserve the right to modify these terms from time to time, and any updates will be posted on our website. By continuing to use Tipinc after any modifications, you accept the updated terms.

2. Appointing Tipinc as Your Commercial Agent

  • You authorize us to act as your non-exclusive commercial agent to collect tips on your behalf and remit them to you.
  • Our role is limited to acting as your commercial agent, and we do not act on behalf of the customer or any third party involved in the tipping process.
  • You can only hold us accountable if we collect tips on your behalf and fail to transfer them to you once available.

3. Term of the Agreement

  • These terms commence once your venue verifies you as an employee and begins using our tipping solution.
  • The agreement will continue until either party serves notice, or you no longer work at the relevant venue.

4. Our Responsibilities

  • Provide access to create your profile, connect to your venue, and manage your tip distribution account.
  • Enable the collection of tips on your behalf and provide visibility into the amounts collected and distributed.
  • Facilitate secure and timely distribution of tips, including issuing a virtual card for funds access where applicable.
  • Process and distribute tips according to your venue’s agreed tipping policy, which you must agree to when you connect to your workplace.

5. Your Responsibilities

  • Provide accurate and updated information when setting up your profile.
  • Confirm employment at the venue and eligibility to work within your region.
  • You are responsible for reporting tips to your local tax authority and complying with all applicable taxation requirements, unless a process is in place between Tipinc and your place of work for tax reporting.
  • Agree to reimburse Tipinc for any claims or losses resulting from non-compliance with these terms.

6. Distribution of Tips

  • You must be connected and verified by your venue to receive tips.
  • Tips are distributed based on your venue’s policy, which may include individual tipping or pooled tipping (group tipping). You agree to the distribution policy when you connect to your workplace through Tipinc.
  • Once collected, tips are deposited into your designated account or Tipinc-issued card. Tipinc will aim to transfer funds in a timely manner, but timeframes may vary based on venue processing and fund clearance.

7. Termination

  • You may cease using Tipinc by deleting your account, which will end your ability to receive tips. Ensure all hours are submitted before account deletion to receive pending payments.
  • We may terminate your use of Tipinc at any time with written notice.

8. Law and Jurisdiction

These terms shall be governed by the applicable laws in the country where you work, and disputes shall be subject to the jurisdiction of the relevant courts.

  • These terms must be read in conjunction with our Privacy Policy and End User License Agreement. By continuing to use Tipinc, you accept these terms and any updates we make.

2. Term of Agreement

  • These terms commence once your venue begins using one of our tipping solutions.
  • The agreement continues until terminated by either party or the venue deletes its Tipinc account.

3. Our Responsibilities

  • Provide the venue access to manage employee profiles, tip distributions, and other relevant services.
  • Offer transparency regarding the tips collected and ensure compliance with relevant laws and industry standards.

4. Venue Responsibilities

  • Accurately provide information during onboarding and update any relevant information as necessary.
  • Maintain good practices by addressing customer concerns related to tipping.
  • Provide accurate information to Tipinc for managing group tips, including hours worked by employees, to ensure fair distribution according to the venue’s agreed tipping policy.
  • Venues must not interfere with the distribution process, and all staff members must have equal access to Tipinc for receiving tips.

5. Liability

  • Tipinc will not be liable for any delays or failures caused by the venue, its staff, or third-party service providers.
  • The venue agrees to indemnify Tipinc against claims related to misuse of the platform or failure to comply with these terms.

6. Termination

  • You may cease using Tipinc by deleting your venue account, which will disable your staff’s ability to receive tips. Ensure all pending tips are processed before deletion.
  • We may terminate this agreement at any time by providing written notice.

7. Consequences of Termination

  • Tipinc will continue to process any pending tips collected on behalf of your staff even after termination, provided that it is legally and operationally feasible.

8. Law and Jurisdiction

  • These terms shall be governed by the laws applicable to the region in which the venue operates, and any disputes will be resolved within the relevant legal jurisdiction.
